A Win For Med-Mal Standards in Georgia

ATLANTA – October 28, 2020

Last week, Georgia’s Court of Appeals expanded the protections for medical providers contained in the 2005 tort reform bill. This is an encouraging development within the civil justice community.

In a case of first impression, Justice Colvin held that heightened gross negligence standard included in the 2005 bill includes care provided in obstetrical units. Now, when faced with an emergency medical condition arising in an obstetrical unit, Plaintiffs must prove that the medical provider was grossly negligent by clear and convincing evidence.  

This decision is a promising move towards a more fair and balanced legal climate in Georgia, there is still more work to be done to balance the scales in Georgia.
